Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Capture Sweet Chrome extension and any related websites, software, and services (collectively, the “Service”), provided by Capture Sweet LLC, a Wyoming limited liability company (“Capture Sweet,” “we,” “us,” or “our”).

By installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Capture Sweet is a browser-based screen recording and documentation tool. The core functionality of the Chrome extension operates locally on your device and does not require an account.

Certain optional features may allow you to upload recordings and associated data to third-party services or to Capture Sweet's cloud-based services, subject to your explicit opt-in.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement.

3. Accounts (Optional)

An account is not required to use the Chrome extension.

If you choose to use optional cloud-based features provided by Capture Sweet, you may be required to create an account. You are responsible for maintaining the security of your account and for all activity that occurs under it.

We reserve the right to suspend or restrict access to cloud features if we reasonably believe you have violated these Terms.

4. Data Storage and User Control

By default, recordings, transcripts, and navigation logs are processed and stored locally on your device.

You control whether any content is uploaded to third-party services or to Capture Sweet's cloud.

If you upload content to Capture Sweet's cloud, it will remain available until you delete it using the available user interface.

We do not impose a retention period after deletion.

5. Paid Plans and Billing

Capture Sweet may offer paid plans in the future. Paid plans may include increased recording limits, longer recordings, storage capacity, and sharing features.

Pricing may be based on the number of videos associated with an account.

Fees are charged in advance for the applicable billing period.

No refunds will be provided for services rendered, except where required by law.

We reserve the right to modify pricing or plan features with reasonable notice.

6. Acceptable Use

You agree not to use the Service to:

• Record or collect information without appropriate consent
• Violate any applicable laws, regulations, or third-party rights
• Infringe intellectual property or privacy rights
• Engage in unlawful surveillance or monitoring
• Interfere with or disrupt the Service or its infrastructure

You are solely responsible for ensuring your use of the Service complies with all applicable laws and obligations.

7. Intellectual Property

The Service, including its software, design, and branding, is owned by Capture Sweet LLC and is protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

You retain ownership of any content you create or upload using the Service.

8. Analytics

We may collect anonymous usage data — such as feature usage, recording duration, and performance metrics — to improve the Service. This data does not identify you personally.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available.”

To the maximum extent permitted by law, Capture Sweet disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, Capture Sweet shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, or goodwill.

Our total liability arising out of or relating to the Service shall not exceed the amount you paid to Capture Sweet in the twelve (12) months preceding the claim, or $100, whichever is greater.

11. Termination

You may stop using the Service at any time.

We may suspend or terminate access to the Service if required by law or if you materially breach these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it enforceable.

14. Entire Agreement

These Terms constitute the entire agreement between you and Capture Sweet regarding the Service and supersede all prior or contemporaneous agreements, communications, or understandings, whether written or oral.

15. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

16. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent.

Capture Sweet may assign these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

17. Survival

Sections relating to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Governing Law and Venue, and any provisions that by their nature should survive shall survive termination of these Terms.

18. Force Majeure

Capture Sweet shall not be liable for any failure or delay in performance due to events beyond its reasonable control, including acts of God, natural disasters, labor disputes, internet or hosting failures, governmental actions, or utility interruptions.

19. Headings

Section headings are for convenience only and have no legal or contractual effect.

20. Governing Law and Venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction.
